A Kansas man who provided sperm for a lesbian couple’s child is now being asked to pay child support. KYTV has the details.

“William Marotta responded to a CraigsList ad from a lesbian couple who wanted a donor back in 2009. Now, he agreed to father the child as long as he relinquished parental rights, including financial responsibility.”

The Kansas City Star reports this couple, Angela Bauer and Jennifer Schreiner, signed an agreement with Marotta, detailing that he would have no parental rights — a seemingly ideal situation for Marotta.

Marotta initially agreed to be compensated, but decided to donate at no charge to the couple.

But the problem-free sperm donation was turned on its head after the couple split in 2010 and Bauer became ill.

The Topeka Capital-Journal reports in the process of Schreiner getting health insurance for the her and Bauer’s daughter, the Kansas Department for Children and Families requested the name of the father. Because the artificial insemination was not performed by a licensed physician, the state pursued Marotta for child support.

Sources say sperm donors that donate through a sperm bank are typically protected by the state, but in other cases, that protection isn’t guaranteed.

NBC reported Bauer was regretful of how the situation played out, saying, "This was a wonderful opportunity with a guy with an admirable, giving character who wanted nothing more than to help us have a child... I feel like the state of Kansas has made a mess out of the situation."

According to The Capital-Journal, Marotta doesn’t blame the couple for how things played out. A judge will hear his motion to dismiss the case Jan. 8.
