You’ve heard of the Mile High Club. Now meet the tandem who took it one step further. Bakersfield’s KGET explains.

“The viral video is so explicit we're only going to show you blurred still images. With a Katy Perry pop song blaring in the background, the video was posted on the age-protected blog of Alex Torres, a porn star who also moonlighted on weekends as an instructor at Skydive Taft.”

There’ll be no more moonlighting for Torres -- he’s been canned by the skydiving company. The Federal Aviation Administration is considering charges, but the circumstances are, well, unique. KSBI has more.

“Here’s the weird twist to the story - the FAA has been brought in to investigate, but they can’t bring any charges against the guy because technically he has to be in the plane distracting the pilot for them to fine him or file any sort of paperwork.”

There’s nothing in FAA’s laws that explicitly regulates sexual activity on a private plane. But the website “Newser” writes what caught the investigators’ eye -- among other things -- was that the risky business started right next to the pilot.

“At one point in the film the couple is having sex in a jump seat next to the pilot, and FAA investigators say the hijinks could have distracted the pilot, which is against regulations -- or ‘jostled’ him -- and caused an accident.”

The owner of the skydiving company told MSNBC the pilot had everything under control -- and maybe played the part of voyeur too.

"He was in complete control of the plane at all times. I mean he looked back a couple of times. The same thing he does if there are other skydivers in the plane. He is going to look back, he's going to look around to see what everyone is doing."

According to local police, no criminal charges will be filed because the sex was consensual, the tandem was of age, and there were no complaints of public nudity during the free fall fornication.
