The alleged Aurora movie theater shooter James Holmes is expected to make his first court appearance Monday for initial advisement. KUSA spoke with a lawyer about the legal process.

“There’s a certain amount of struggle in United States Supreme Court as to whether mental illness alone prevents the death penalty from being imposed.”

According to the Denver Post, legal analysts predict Holmes will face at least 71 charges, one for each victim who was shot.

“For now, two of the biggest questions regarding Holmes' legal case are whether the District Attorney will seek the death penalty and whether his defense team will ask the state to determine whether he is competent to stand trial...”

CNN spoke with legal analysts who believe Holmes will be put through several psychological tests to determine his mental health.

“In my opinion, you do not try to acquit him of a shooting. What you try to do is save him from execution and that's going to be a daunting task. Right now he's the most hated man in America.”

Investigators haven’t released information about Holmes’ motive or evidence, leaving many unanswered questions. An MSNBC correspondent says prosecutors want all the evidence to be used against Holmes in court.

“Police are responding so gingerly to this because they don't want to destroy what could be crucial evidence as to why he did what he did”

Aurora’s District Attorney Carol Chambers may be replaced in November which could lead to new sentencing. But, until then, The New York Daily News is focused on her history.

“District Attorney Carol Chambers, who will charge Holmes, has not been hesitant in the past to seek the death penalty. She has sought the death penalty six times during her tenure and two of the three men on death row in Colorado were placed there by her team.”

Holmes is being held in the Arapahoe County Jail under solitary confinement for his own safety.
