The Australian Government’s highly controversial Malaysian Solution was overruled by the High Court on Tuesday. The ‘Solution’ would have enabled Australia to send 800 illegal asylums from their shores to Malaysia, in return for 4000 genuine refugees over four years.
Channel Ten reports.
“The Gillard Government’s Malaysian Solution is in tatters tonight...
Court number 1 was packed, history in the making, an overwhelming majority 6-1 found Australia’s obligation to protect refugees was not guaranteed by the Malaysian deal.”
Opposition Immigration Spokesman Scott Morrison explains the decision, noting Malaysia’s human rights record --
‘I’ve been to Malaysia, I’ve seen the conditions that asylum seekers live in, and it was clear to me the protections the minister boldly claimed existed clearly simply didn’t exist.
But not everyone is pleased with the result from the High Court hearing. Immigration Minister Chris Bowens spoke to the press following the ruling-
‘Today’s decision by the high court is a profoundly disappointing one. Disappointing to the Government, disappointing to me. It is a significant blow to our efforts to break the smugglers business model.’
With the Government’s plan for a refugee swap deal with Malaysia officially anchored for the time -- people are asking, what happens now? The Australian reports another group affected by the decision --
“ONE likely but unintended consequence of the High Court's rejection of the Malaysian asylum-seeker swap is its effect on Australia's intake of African refugees...”
And the Malaysian Star spoke with the country’s Home minister, who says the two countries will continue finding a solution.
“The law must be respected. In the meantime, Malaysia and Australia will find alternative ways to continue the fight against human trafficking.”
As of last Friday, there are 4427 illegal immigrants being held in detention centres in Australia.
