The public is getting a rare peek at Tuscon shooting suspect Jared Loughner’s behavior since his arrest.
Courtesy -- his lawyers.
ANCHOR: “In court records, Jared Lee Loughner’s attorneys are saying their client threw a plastic chair against the wall of his prison cell on two occasions and spit on one of his lawyers about two months ago. They also say Loughner has been held in solitary confinement since his arrest.” (KMSB)
The court record -- is a request by Loughner’s attorneys -- seeking to prevent the forcible medication of their client.
ANCHOR: “The defense filed an emergency motion Friday asking the judge to stop them -- but the judge has twice denied their request to be given notice before Loughner is drugged.” (KTVK)
Loughner has been at a federal facility in Springfield, Missouri since he was ruled incompetent to stand trial back in May.
Experts concluded Loughner does not understand the trial proceedings or the concept of witnesses, and believes there is a conspiracy against him.
And mental health experts at the Missouri facility are tasked with improving Loughner’s psychological state -- until he is fit to stand trial. (Video: Fox News)
Loughner’s attorneys argue -- their client has a right to a proper court proceeding before officials can forcibly medicate him.
The Arizona Daily Star reports -- at a hearing on June 14th -- a social worker, not his legal counsel -- was present as his advocate.
But prison authorities insist his erratic behavior -- is the reason prison authorities want to administer medication.
“At that hearing, prison officials determined that because of the chair-throwing and spitting incidents, Loughner is a danger to others, the filing says. And because he is a danger to others in the prison, they determined, he should be treated with anti-psychotic medications.”
But Loughner’s attorneys -- aren’t buying that.
They argue -- the system is trying to circumvent the proper procedures -- using his behavior as an excuse.
Politico quotes them as writing...
"Countless prisoners, detainees and institutionalized people have spit or worse, including throwing feces or urine ... physically assaulting and injuring other inmates and guards, without being subject to forced medication, much less mind-altering psychotropic medications.”
Loughner’s next court date is scheduled for September.
