An 89-year-old man charged with Nazi war crimes in Germany is taken from his U.S. home by federal immigration officials.

Germany asked the U.S to extradite John Demjanjuk but at the last minute an American judge intervened.

Demjanjuk, who suffers from cancer, would be charged with killing 29,000 Jews if extradited.

CNN spoke with Demjanjuk’s son who says his father does not have the mental capacity to face trial.

“Anchor: So you’re saying it’s too late? Son: The fact remains that he’s not capable of defending himself today, but if we had to deal with the facts, we certainly could, but we can’t do so without him.”

Spiegel Online International reported Demjanjuk’s attorneys are afraid what a trial would do to his health.

“His attorneys had argued that he could face "torture" in Germany -- the reason, they claimed, is that the country planned to put him on trial despite his state of health.”

“The Simon Wiesenthal Center which has long advocated that John Demjanjuk be deported is unimpressed, it released this statement “his work at the  Sobibor death camp was to push men women and children into the gas chamber the had no mercy, no pity, and no remorse for the families whose lives he was destroying forever.” (ABC News)

France 24 says that Demjanjuk’s trial is representative of a greater issue.

“He wasn’t a high ranking German Sergeant, or decision-maker, but was one of hundreds of thousands non-Germans often from Central and Eastern Europe who willingly helped the Nazis kill the Jews.  Now many of the high profile German Nazis have already been brought to trial, but until now it’s been impossible to convict any of these non-Germans without whom the Holocaust could never have happened.”  (France 24)
