In Indiana, a young boy could be tried for murder as an adult - that would make him the youngest person to be charged with murder in 90 years. Indianapolis’ WISH-TV explains.
“Police and prosecutors in Morgan County announced murder charges against an 11-year-old for the shooting of his 6-year-old brother."
As WTHR reports, police treated the killing of Andrew Frye as an unintentional at first.
“Initially police believed this was simply a tragic accident after they say the 11-year-old called 911 to report his little brother had shot himself. The children’s parents were not home at the time. The prosecutor said they could also face charges."
Morgan County prosecutors are keeping the details secret for now, but say details discovered over the course of the investigation changed their minds.
Neighbors tell WSBT the parents are ultimately to blame.
Reporter: “Neighbors say no child, regardless of their age, should be left around guns.”
Neighbor: “You should never leave a kid in a house with a gun unless it’s locked separately, or in a lockbox or a gun case. Especially not with kids that can be curious.”
Reporter: “Whether or not that gun was locked remains to be seen.”
An Indiana University School of Law professor tells Indy Star - an 11-year-old is simply too young to be tried as an adult.
"I would not waive an 11-year-old. It's essentially giving up on rehabilitation for a kid."
If convicted as an adult, the young boy could face between 45 and 65 years in prison.
